Referral Program Terms & Conditions

By participating in the referral program offered by The Maryland Painting Company, you ("Affiliate") agree to the following terms and conditions:


1. Purpose

This agreement establishes a referral relationship. You may refer potential clients to The Maryland Painting Company in exchange for referral compensation, subject to the terms outlined here.

These terms apply to any services currently or later offered by the Company. You are not authorized to act on the Company’s behalf beyond submitting referrals.

2. Definitions

  • Client: A person or business you refer to the Company.
  • Pending Referral: A referral currently being contacted or scheduled by the Company.
  • Qualified Referral: A referral that has agreed to work with the Company, but work is not yet completed.
  • Approved Referral: A referral where the work has been completed and reviewed internally.
  • Commission: The $69.00 flat-rate payment for each Approved Referral.

3. Referral Submission

  • All referrals must be submitted through the Company’s online scheduling tool or interest form.
  • You must include your referral code in the description.
  • The referral must include the client’s full name, address, and contact information.
  • If you forget to include your referral code, you may call 301-241-6440 to request manual assignment.

4. Referral Validity

  • A referral is only valid if the client is not already in the Company’s system.
  • Referrals expire after 60 calendar days if no agreement is made with the client.
  • Only referrals marked as Approved by the Company are eligible for Commission.

5. Commission Payment

  • Commission is $69.00 per Approved Referral.
  • Payment is made via PayPal only. A PayPal account is required.
  • Commissions are paid on a bi-weekly or weekly job review cycle.
  • The Company is not responsible for PayPal-related delays or issues.

6. Tax Compliance

  • You are responsible for all applicable taxes on your earnings.
  • A W-9 form will be required once your total earnings reach $600.
  • The Company will issue a 1099-NEC for qualifying earnings in accordance with IRS rules.

7. Independent Status

You are not an employee, agent, partner, or representative of the Company. You will not receive employee benefits, and you cannot bind the Company in any way.

8. Confidentiality & Non-Solicitation

  • You agree not to use or share any client or Company information you receive.
  • You may not solicit or market your own or third-party services to any client referred to the Company during this agreement or within 12 months of termination.

9. Liability & Indemnification

You are responsible for your actions. The Company is not liable for any unauthorized representations or promises you make. You agree to indemnify and hold the Company harmless from any claims resulting from your conduct or breach of these terms.

10. Termination

  • These terms remain in effect until terminated by either party.
  • The Company or Affiliate may terminate participation at any time.
  • Referrals not marked as Approved at the time of termination will not be eligible for Commission.

11. Governing Law

These terms are governed by the laws of the State of Maryland. Any disputes shall be resolved in the courts of Maryland.

12. Agreement to Terms

By checking the box during sign-up and submitting your information, you confirm that you have read, understood, and agreed to these Referral Program Terms & Conditions.

The Maryland Painting Company Process

Initial Stage

Consultation

A representative from The Maryland Painting Company will meet with you to discuss your vision for the project and take measurements. We provide an estimate that includes the cost of materials, labor, and any additional services, such as preparing the surface or moving furniture. We can even arrive with sample colors at your request?.

Second Stage

Preparation

After accepting our estimate and signing our agreement, on the day of the painting, The Maryland Painting Company will prepare the surface for painting, which includes protecting the floors or furniture, filling any cracks or holes, and sanding and priming the surface. We will also confirm the paints to be used for each area.

Third Stage

Painting

The Maryland Painting Company applies paint using industry best practices, high-quality techniques and equipment. We ensure an even coat and clean lines around edges and corners. We address any issues or concerns that arise during the process. We take pride in our work.

Final Stage

Final Inspection

Upon completion we inspect our work with you to ensure satisfaction with the final result. We also clean up the workspace, remove any protective materials, and return furniture to its original location. We provide a wide variety of ways to pay your invoice.
